These terms define the professional relationship between SafeGuard Marine Survey and the Client. They are designed to provide a clear framework for the delivery of technical reports on FRP vessels and Steel Narrowboats across East Anglia and the UK inland waterways.
1. Scope of the Survey and Inspection
The survey is a professional assessment of the vessel's condition at a specific point in time.
Non-Destructive Testing (NDT): Unless explicitly stated, the inspection is non-destructive. It does not involve the removal of fixed linings, heavy machinery, or tanks.
Material Specifics:
For Steel Narrowboats, assessments rely on Ultrasonic Thickness (UT) gauging at selected points; this is a sampling process and does not guarantee the thickness of every square centimetre of the hull.
For FRP Vessels, moisture profiling is indicative of the laminate state at the time of testing. Readings can be influenced by recent launch/recovery and ambient humidity.
Exclusions: Engines, sail drive diaphragms, and internal tank surfaces are excluded from the standard structural scope unless a specific system survey is requested.
2. Surveyor’s Obligations
The Surveyor will exercise reasonable skill and care in performing the services. The report represents an independent, professional opinion based on areas visible and accessible at the time of the survey. It is not a guarantee or a warranty against future defects or "latent" issues that were not detectable during the physical inspection.
3. Liability and Indemnity
The management of professional liability is a significant element of this agreement.
Financial Limit: The Surveyor’s total liability for any claim (whether in contract or tort) shall be limited to a sum not exceeding ten times the fee paid for the specific survey, or the limit of the Surveyor's Professional Indemnity Insurance, whichever is lower.
Third Parties: The report is prepared for the sole and confidential use of the Client. No liability is accepted to any third party (such as subsequent buyers, brokers, or lenders) unless explicitly agreed in writing beforehand.
4. Fees and Payment Terms
All fees are quoted and payable in Pounds Sterling (£).
Payment is required in full prior to the release of the final written report.
Travel expenses for surveys within the East Anglia region will be itemised in the initial quote.
5. Cancellation and Vessel Preparation
Cancellations: If a survey is cancelled by the Client within 48 hours of the scheduled inspection, a fee of 50% of the quoted total may be charged to cover lost instruction time.
Preparation: The Client is responsible for ensuring the vessel is appropriately prepared (e.g., lockers cleared, bilges dry). Any delays caused by poor preparation may result in an additional "waiting time" charge.
6. Jurisdiction and Law
These terms and the resulting contract are governed by the laws of England and Wales. Any disputes that cannot be resolved through professional mediation shall be subject to the exclusive jurisdiction of the English Courts.
